The participant hereby acknowledge and agree to the following terms and conditions in consideration of being permitted to participate in the pottery throwing and hand building class provided by Create Me Pottery:
Assumption of Risk: I understand that pottery throwing and hand building involve inherent risks, including but not limited to the use of spinning wheels, machinery, and sharp tools. I acknowledge that these activities may result in injury, including cuts, bruises, burns, or other harm.
Acknowledgment of Safety Guidelines: I acknowledge that it is my responsibility to adhere to all safety guidelines provided by the instructor or staff. I understand that these guidelines may include but are not limited to tying back hair, wearing appropriate attire without flowy clothing or hanging objects, and following instructions regarding the proper use of equipment and tools.
Release of Liability: I hereby release, waive, discharge, and covenant not to sue Create Me Pottery, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, whether caused by the negligence of the releasees or otherwise, while participating in the pottery throwing and hand building class.
Indemnification: I agree to indemnify and hold harmless Create Me Pottery, its owners, employees, agents, and representatives from any loss, liability, damage, or costs, including attorney fees, that they may incur arising out of or related to my participation in the pottery throwing and hand building class.
Medical Treatment: In the event of an injury or medical emergency, I authorize the staff of Create Me Pottery to administer first aid and seek medical treatment as they deem necessary.
Photography and Publicity: I grant permission to Create Me Pottery to take photographs or videos of me during the class for promotional or educational purposes. I waive any right to inspect or approve the finished product and release all claims to compensation in connection with such use.
Governing Law: This waiver and release shall be construed and interpreted in accordance with the laws of Pennsylvania.
Shrinkage, Cracking, and Breakage: I acknowledge that pottery items made during the class may experience shrinkage, cracking, or breakage during the drying, firing, or handling process. I understand that these occurrences are natural aspects of working with clay and that Create Me Pottery is not responsible for any shrinkage, cracking, or breakage of clay items made during the class.
No Returns or Refunds: I understand and agree that there will be no returns or refunds for the pottery throwing and hand building class fees. Once payment is made, it is non-refundable regardless of my attendance or participation in the class.
I have read this waiver and release of liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
